Terms of Service

These terms set out the agreement between you and Janitor when you use the Service, including your account, billing, acceptable use and the law that applies.

01 These terms

These Terms of Service (the “Terms”) govern your access to and use of Janitor (the “Service”), provided by Janitor (“Janitor”, “we”, “us” or “our”). By creating an account, starting a trial or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service is a business tool for agencies, freelancers and other organisations. By using it you confirm you are acting in the course of a business or profession and are at least 18 years old. If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms, and “you” means that organisation.

02 The Service

Janitor monitors the websites you add, runs automated checks across areas such as uptime, TLS and domains, DNS and email, SEO, security, privacy and performance, sends alerts when checks fail, and compiles the results into branded reports you can share with your clients.

The Service is provided for information and operational support. The checks are automated and best-effort: they help you spot problems sooner, but they are not a guarantee that a site is available, secure or compliant, and they are not a substitute for your own professional judgement. You remain responsible for the sites you manage.

03 Your account

To use the Service you need an account. You agree to:

  • provide accurate registration details and keep them up to date;
  • keep your login credentials confidential and not share your account;
  • take responsibility for everything that happens under your account; and
  • tell us promptly at support@getjanitor.com if you suspect any unauthorised use.

You are responsible for the acts of anyone you invite to your account, including team members and collaborators, and for making sure their use complies with these Terms.

04 Trials and plans

We offer a free trial so you can use the Service on real sites before you pay. No credit card is required to start a trial. We may change the length or terms of trials, or withdraw a trial, at any time.

Paid plans differ in the number of sites you can monitor, the number of pages crawled per site and how often each site is crawled. Every feature is included on every paid plan. The current plans and limits are set out on our pricing page, which forms part of these Terms.

05 Fees, billing and renewals

Paid plans are billed in advance on a recurring basis, either monthly or annually, in the currency shown at checkout. All prices are exclusive of any taxes, which we will add where required.

  • Renewals: subscriptions renew automatically at the end of each billing period at the then-current price, until you cancel.
  • Payment: you authorise us and our payment processor to charge your payment method for each renewal. If a payment fails, we may retry it and may suspend the Service until it is resolved.
  • Changes to pricing: we may change our prices, and will give you reasonable notice before a change applies to your next renewal. Continuing to use the Service after that means you accept the new price.
  • Upgrades and downgrades: if you change plan, the change and any adjustment to your fees take effect as described at the time you make it.

06 Cancellation and refunds

You can cancel your subscription at any time from your account settings. Cancellation stops the next renewal and takes effect at the end of your current billing period, so you keep access until then.

Except where the law requires otherwise, fees already paid are non-refundable, and we do not provide partial refunds for unused time in a billing period. If you believe you have been charged in error, contact us and we will look into it.

07 Acceptable use

You agree not to use the Service to, and not to allow anyone else to:

  • break the law, infringe anyone’s rights, or monitor a site you are not authorised to monitor;
  • gain or attempt to gain unauthorised access to any system, network or data;
  • interfere with or disrupt the Service, or place an unreasonable load on it, including by scraping or excessive automated requests outside the features we provide;
  • reverse engineer, copy or resell the Service except as allowed by law;
  • upload malware, or use the Service to send spam or unlawful content; or
  • use the Service to build a competing product.

We may investigate suspected breaches and may suspend or limit access to protect the Service and other users.

08 The sites you monitor

You may only add sites that you own or that you are authorised to monitor on behalf of their owner. By adding a site, you confirm that you have the necessary rights and permissions to have it monitored and checked by the Service.

You are responsible for your use of the data the Service produces, including any reports you send to your clients. You agree to indemnify us against claims arising from your monitoring of a site you were not authorised to monitor, or from your misuse of the results.

09 Your content and data

You keep all rights in the content and data you provide, including your branding, the sites and client details you add, and the configuration you create (“Your Content”). You grant us a non-exclusive, worldwide licence to host, process and display Your Content only as needed to provide and improve the Service for you.

You are responsible for the accuracy and lawfulness of Your Content and for having the rights to use any logos, names and branding you upload. Our handling of personal data is described in our Privacy Policy, and where we process personal data on your behalf we do so as your processor in line with that policy.

10 Our intellectual property

The Service, including its software, design, branding and content we create, is owned by Janitor and its licensors and is protected by intellectual property laws. These Terms do not transfer any of our intellectual property to you. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with these Terms for as long as your subscription is active.

If you send us feedback or suggestions, we may use them to improve the Service without any obligation to you.

11 Third-party services

The Service can connect to third-party tools you choose, such as email, Slack or your own webhooks, so that alerts and reports reach you. Your use of those tools is governed by their own terms, and we are not responsible for them. If a third-party service changes or becomes unavailable, the related Janitor features may be affected.

12 Availability and changes to the Service

We work to keep the Service available and reliable, but we do not promise it will be uninterrupted or error-free. We may carry out maintenance, and parts of the Service may be unavailable from time to time. We may also add, change or remove features as the Service develops. If we make a material change that significantly reduces the core Service, we will give you reasonable notice.

13 Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, and we exclude all warranties, conditions and terms that are not expressly set out in these Terms, whether implied by statute or otherwise. In particular, we do not warrant that the checks will detect every issue, that monitoring will catch every outage, or that the Service will meet every requirement you have. You are responsible for your own decisions based on the information the Service provides.

14 Limitation of liability

Nothing in these Terms limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud.

Subject to that, and to the fullest extent permitted by law:

  • we are not liable for loss of profits, loss of business, loss of goodwill, or loss of or damage to data, or for any indirect or consequential loss, in each case however arising; and
  • our total liability to you for all claims arising out of or relating to the Service in any twelve-month period is limited to the fees you paid us for the Service in that period.

This section reflects the business nature of the Service and the price you pay for it.

15 Suspension and termination

You can stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us, other users or third parties. Where it is reasonable to do so, we will give you notice and a chance to put things right first.

When your account ends, your right to use the Service stops. We will handle any personal data as described in our Privacy Policy, and you should export anything you want to keep before your account closes. Sections that by their nature should survive termination, such as those on intellectual property, disclaimers, liability and governing law, will continue to apply.

16 Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to the Service or the law. When we do, we will revise the “last updated” date at the top of this page, and for significant changes we will give you reasonable notice, such as by email or a notice in the app. If you continue to use the Service after a change takes effect, you accept the updated Terms.

17 Governing law and contact

These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

If any part of these Terms is found to be unenforceable, the rest will continue to apply. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a reorganisation, merger or sale.
